1. Controller, scope and contact

SPZ Marketing LTD (“SPZ”, “we”, “us” or “our”) is the controller of personal data described in this Privacy Policy where SPZ determines why and how that personal data is used.

This Privacy Policy applies to macbend.com, macbend downloads and licensing, purchases, customer support and the macbend referral programme. It is intended to explain our processing under the UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 and other applicable UK data-protection law as amended from time to time.

2. Privacy by design: what macbend does not collect from your screen

macbend does not send your screen content to SPZ. The macOS Screen Recording permission is used so macbend can use ScreenCaptureKit or an equivalent supported Apple framework to render the visual fold effect locally.

Screen frames used to render that effect are processed transiently on your Mac. They are not intentionally recorded to disk by macbend, retained by SPZ, uploaded to our servers, transmitted to a cloud processor, used for advertising, or used to train an artificial-intelligence model.

Because SPZ does not receive those screen frames, they are not part of the personal data SPZ processes through ordinary operation of the macbend visual effect. Other software on your Mac, macOS itself, or software you independently use may process screen information under their own rules; this Privacy Policy does not describe those independent products.

3. Personal data we collect

Depending on how you interact with macbend, we may process the following categories:

  • Website and download technical data: IP address, request date/time, requested page or download, browser or user-agent information, basic device/network information, referrer information where supplied, and server/security logs generated when you visit macbend.com or download the DMG.
  • Purchase and order data: name if supplied, email address, country or billing details made available to us by Stripe, transaction/order identifier, amount, currency, payment status, refund/dispute status, product purchased, and limited payment-method details such as brand and last digits where Stripe makes those available. SPZ does not need to receive your full card number or card security code.
  • Licence data: licence key or licence identifier, licence status, number of permitted activations and records reasonably necessary to administer the three-MacBook limit. Where online activation is used, this may also include limited activation data such as a pseudonymous installation identifier, activation timestamp, app version, and network information (such as IP address) needed to verify the licence, prevent abuse and provide support. We minimise this data and do not use it to access your screen content. Retention is described in section 11.
  • Support and communications: your email address or Telegram account identifier, message content, attachments you choose to send, troubleshooting information you choose to provide, and our replies. Please avoid sending screenshots containing unnecessary personal or confidential information.
  • Referral programme data: your own email address, referral code or referral link, referral/redemption status and any reward status needed to administer the programme. This notice assumes we do not ask you to give us a friend's email address for unsolicited referral marketing.
  • Privacy, legal and complaint records: identity/contact details and records reasonably needed to respond to a rights request, legal enquiry, complaint, fraud concern or dispute.

No in-app analytics: macbend does not include third-party in-app behavioural analytics under the product configuration described in this Policy.

4. Why we use personal data and our lawful bases

Where we rely on legitimate interests, we consider whether the processing is reasonably necessary and balance those interests against your rights and reasonable expectations. You may object to legitimate-interests processing as described in section 13.

5. Screen content and Screen Recording permission

Granting macOS Screen Recording permission is an operating-system permission required for the local visual effect. It is not permission for SPZ to collect or upload your screen content. SPZ does not use Screen Recording permission as a mechanism to obtain marketing consent or data-protection consent.

You can revoke the permission in macOS System Settings. If you revoke it, the fold effect may stop working. Uninstalling macbend and revoking the operating-system permission do not by themselves delete transaction or support records that SPZ must or is entitled to retain separately.

6. Payments and Stripe

Stripe provides payment-processing infrastructure for macbend. When you pay, Stripe may collect information such as payment-card or other payment-method details, name, email, billing information, IP/device information, transaction details and fraud-prevention information.

Stripe's legal role depends on the processing. Under Stripe's current Data Processing Agreement, Stripe acts as our processor for certain processing it performs on our behalf, and acts as an independent controller for certain purposes it determines itself, including fraud prevention, security, compliance with financial/legal obligations, use of financial providers and aspects of Stripe's own service operation and improvement.

Stripe's own privacy information applies to its controller activities. We recommend reading Stripe's Privacy Center and privacy notice before paying. SPZ receives only the payment and transaction information made available to merchants through Stripe that we need for order, support, fraud, accounting, refund and dispute purposes.

7. Referrals and electronic marketing

Where we offer “Refer & Earn”, the privacy-safe design assumed by this Policy is that we issue you a referral link or code that you control. We do not ask you to upload a contact list, and we do not ask you to submit a friend's email address so that SPZ can send that person unsolicited marketing.

You must not use our referral programme to send spam or unlawful electronic marketing. If we ever change the referral programme so that SPZ sends or instigates electronic marketing to referred individuals, we will first implement the consent and transparency measures required by PECR and applicable data-protection law and update this Policy.

Operational emails that are necessary to deliver a purchase, licence, refund, support response or requested referral reward are not used as a pretext for unrelated marketing. If we introduce optional marketing emails, we will provide the consent/opt-out mechanism required by applicable law.

8. Cookies and similar storage/access technologies

At the effective date of this Policy, macbend.com uses only strictly necessary first-party cookies or equivalent storage/access technologies required for core site functionality, security or the purchase flow. We do not use advertising cookies, profiling cookies, or third-party behavioural analytics cookies on macbend.com under the configuration described here.

Strictly necessary storage/access technologies may be used without consent where PECR or another applicable rule provides the relevant exemption, but we still provide information about their use. If we later add a non-essential technology for which consent is required, we will update this Policy and deploy an appropriate consent mechanism before using it.

The macbend app itself does not contain third-party behavioural analytics under the configuration described in this Policy.

9. Sharing and disclosure

We do not sell or rent your personal data. We disclose personal data only where reasonably necessary for the purposes in this Policy, including:

  • Stripe: for payment processing, fraud prevention, refunds, disputes and related payment operations, with Stripe acting as processor and/or independent controller depending on the activity.
  • Website, hosting and delivery providers: our website hosting, content-delivery, download-delivery, transactional-email and support-tool providers process limited technical and order data on our instructions as processors where needed to operate macbend.com, deliver downloads and licences, send order confirmations, and handle support. We do not allow them to use this data for their own marketing.
  • Authorities, courts and advisers where required: where disclosure is required by law, necessary to protect legal rights, prevent fraud or security abuse, or establish, exercise or defend legal claims.
  • Corporate transaction recipients: if the macbend business or relevant assets are genuinely reorganised, financed, merged or sold, subject to appropriate confidentiality and data-protection requirements.

If you choose to contact us through Telegram, you independently choose to use Telegram's service and Telegram will process account/message information under its own terms and privacy policy.

10. International transfers

SPZ is established in the United Kingdom. Some service providers, payment networks or recipients involved in providing payments or support may process personal data outside the UK.

Where UK data-protection law treats a disclosure as a restricted international transfer, we use or rely on an available lawful transfer mechanism as applicable, such as UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, an applicable data-privacy framework recognised for UK transfers, or another mechanism permitted by law. Stripe's current Data Processing Agreement incorporates transfer mechanisms for UK personal data, including the UK International Data Transfer Addendum where applicable. Where our hosting, email, download, support or licence providers process data outside the UK, we ensure an applicable safeguard and appropriate contractual protections are in place as required by UK data-protection law.

11. Retention

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected, including legal, tax, accounting, fraud-prevention, support and dispute purposes. We periodically review data that no longer needs to be kept.

The exact fields depend on the activation design described in section 3.
Referral recordsKept for as long as necessary to administer the referral and reward, and for a reasonable period afterwards for accounting, fraud prevention and dispute purposes, then deleted, unless financial records must be retained longer by law.
Privacy-rights request recordsKept for as long as necessary to demonstrate handling and compliance and to resolve any follow-up complaint, then deleted, unless longer retention is required by law.

Where data is held by Stripe as an independent controller, Stripe determines its own retention periods for that processing under its privacy terms.

12. Security

We use technical and organisational measures appropriate to the nature and risk of the personal data we process. Our privacy design reduces risk by keeping the macbend screen-frame processing on-device and by using Stripe rather than collecting full card credentials ourselves.

No method of electronic storage, transmission or software operation is guaranteed to be completely secure. If we become aware of a personal-data breach, we will assess and handle it in accordance with applicable law, including any required notifications.

13. Your data-protection rights

Depending on the circumstances and applicable law, you may have rights to:

  • be informed about how your personal data is used;
  • request access to personal data we hold about you;
  • ask us to correct inaccurate or incomplete personal data;
  • ask us to erase personal data in circumstances where the right applies;
  • ask us to restrict processing in circumstances where the right applies;
  • receive certain personal data in a portable format or ask for it to be transmitted where the portability right applies;
  • object to processing based on legitimate interests, subject to the legal tests that apply;
  • object at any time to use of your personal data for direct marketing; and
  • withdraw consent at any time where we rely on consent, without affecting processing that was lawful before withdrawal.

macbend does not use personal data received by SPZ to make solely automated decisions producing legal or similarly significant effects under the product configuration described in this Policy.

To exercise a right, email [email protected]. We may request information reasonably necessary to verify your identity and protect your data. Rights are subject to exemptions and limitations in applicable law. We will respond within the legally required period.

14. Complaints to us and the ICO

If you have a privacy concern, please contact us at [email protected] so we can investigate.

You also have the right to complain to the UK Information Commissioner's Office (ICO), the UK supervisory authority for data protection. Information about making a complaint is available at https://ico.org.uk/make-a-complaint/. You may also have the right to complain to another competent supervisory authority where applicable.

15. Children

macbend is a general-purpose desktop utility and is not directed to children under 13. We do not knowingly design the service to collect personal data from children under 13. A person under 18 should not make a paid purchase without the involvement and authorisation of a parent or legal guardian. If you believe a child has provided personal data to us inappropriately, contact [email protected].

16. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes in macbend, our service providers, the law or our processing. We will post the updated version at https://macbend.com/privacy and change the effective date. Where a change materially affects how we use personal data and applicable law requires additional notice or consent, we will provide it before the new processing begins.
